Terms of Use

Please read the following text completely.  Your use of this site will constitute acceptance of our policies.  If you do not agree with the terms, discontinue the use of this site immediately.


1. User Conduct:

By accessing The Book Stand, you agree that you will not: 

·    Use the Service for any purpose that is unlawful or prohibited by these Terms. 

·    Restrict or inhibit any other User from using and enjoying the Interactive Features.

·    Alter, damage or delete any Content or other communications that are not your own Content or to otherwise interfere with the ability of others to access "The Book Stand.

·    Disrupt the normal flow of communication in an Interactive Area.

·    Claim a relationship with or to speak for any business, association, institution or other organization for which you are not authorized to claim such a relationship.

·    Use any device, software or routine to interfere or attempt to interfere with the proper working of the Service and will not send automated queries of any sort to the Service.

·    Violate any operating rule, policy or guideline of your Internet access provider or online service.

·    By using "The Book Stand" to advertise and sell your textbooks, you agree that you will not. 

·    Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane, or indecent information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national, or international law.

·    Post or transmit any information, software, or other material which violates or infringes in the rights of others, including material which is an invasion of privacy or publicity rights or which is protected by copyright, trademark or other proprietary right, or derivative works with respect thereto, without first obtaining permission from the owner or right holder. 

·    Post or transmit any information, software or other material which contains a virus or other harmful component.

·    You agree that you will not use any robot, spider, other automatic device, or any manual process to monitor, copy, modify, distribute, or publish any web pages within The Book Stand or the content contained thereon without our prior written consent.

·    We may terminate your account or suspend your access to all or part of The Book Stand, without notice, if you violate these Terms of Use or if you engage in any conduct that we, in our sole discretion, believe is in violation of any applicable law or regulation or is otherwise harmful to the interests of The Book Stand, any other user of The Book Stand, or any third party. If your account is terminated, we may, but are not required to, remove some or all of your content from our servers.  


2. Content 

    You understand that all postings, messages, text, files, or other materials ("Content") posted on, transmitted through, or linked from the Service, are the sole responsibility of the person from whom such Content originated. More specifically, you are entirely responsible for all Content that you post, email or otherwise make available via the Service. You understand that The Book Stand does not control, and is not responsible for Content made available through the Service, and that by using the Service, you may be exposed to Content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable. Furthermore, The Book Stand site and Content available through the Service may contain links to other websites, which are completely independent of The Book Stand. The Book Stand makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such site. Your linking to any other websites is at your own risk. You agree that you must evaluate, and bear all risks associated with, the use of any Content, that you may not rely on said Content, and that under no circumstances will The Book Stand be liable in any way for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise made available via the Service. You acknowledge that The Book Stand does not pre-screen or approve Content, but that The Book Stand shall have the right (but not the obligation) in its sole discretion to refuse, delete or move any Content that is available via the Service, for violating the letter or spirit of the Terms or for any other reason.


3. Limitation of Liability  

    UNDER NO CIRCUMSTANCES SHALL THE BOOK STAND BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF THE BOOK STAND HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM ANY ASPECT OF YOUR USE OF THE BOOK STAND SITE OR THE SERVICE, WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE BOOK STAND SITE OR THE SERVICE, FROM INABILITY TO USE THE BOOK STAND SITE OR THE SERVICE, OR THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF THE BOOK STAND SITE OR THE SERVICE.  SUCH LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE BOOK STAND SITE OR THE SERVICE OR ANY LINKS ON THE BOOK STAND SITE, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE BOOK STAND SITE OR THE SERVICE OR ANY LINKS ON THE BOOK STAND SITE.  THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERITTED BY LAW. In some jurisdictions, limitations of liability are not permitted.  In such jurisdictions, some of the foregoing limitation may not apply to you.


4. Disclaimer of Warranties:

    YOU AGREE THAT USE OF THE BOOK STAND SITE AND THE SERVICE IS ENTIRELY AT YOUR OWN RISK. THE BOOK STAND SITE AND THE SERVICE ARE PROVIDED ON AN "AS IS" OR "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND.  ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
NON-INFRINGEMENT OF PROPRIETARY RIGHTS ARE EXPRESSLY DISCLAIMED TO THE
FULLEST EXTENT PERMITTED BY LAW.  TO THE FULLEST EXTENT PERMITTED BY LAW, THE BOOK STAND DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY,
TIMELINESS, ACCURACY, AND PERFORMANCE OF THE BOOK STAND SITE AND THE
SERVICE. TO THE FULLEST EXTENT PERMITTED BY LAW, THE BOOK STAND DISCLAIMS ANY WARRANTIES FOR OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE BOOK STAND SITE OR THE SITES OR SERVICE, OR ACCESSED THROUGH ANY LINKS ON THE BOOK STAND SITE.  TO THE FULLEST EXTENT PERMITTED BY LAW, THE BOOK STAND DISCLAIMS ANY WARRANTIES FOR VIRUSES OR OTHER HARMFUL COMPONENTS IN CONNECTION WITH THE BOOK STAND SITE OR THE SERVICE.  Some jurisdictions do not allow the disclaimer of implied warranties.  In such jurisdictions, some of the foregoing disclaimers may not apply to you insofar as they relate to implied warranties.


5. Termination of Service

    You agree that The Book Stand, in its sole discretion, has the right (but
not the obligation) to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to or use of the Service (or any part thereof), immediately and without notice, and remove and discard any content within the Service, for any reason, including, without limitation, if The Book Stand believes that you have acted inconsistently with the letter or spirit of the Terms. Further, you agree that The Book Stand shall not be liable to you or any third-party for any termination of your access to the Service.  Further, you agree not to attempt to use the Service after said termination.
